Department of Justice Enters Lawsuit to Halt California's New Electoral Map
The US Justice Department has officially joined a legal challenge initiated by California Republicans, aiming to block the state's recently passed congressional redistricting map.
This legal action, filed in federal court, targets the redistricting plan supported by the state's Democratic governor, which was developed in reaction against a Republican-led gerrymander in Texas.
"The state's electoral map constitutes a blatant attempt to seize control that violates voting rights and undermines the democratic process," declared the US attorney general.
Democrats have expressed confidence that the redistricting plan will withstand legal scrutiny.
"These opponents were defeated in the election and they are likely to face defeat in the judicial system," commented a representative for the governor.
Legal Basis
The lawsuit claims that California's map improperly used racial considerations to significantly advantage Latino communities in violation of the US Constitution.
"Race cannot be used as a substitute to further partisan goals, but that is exactly what the California General Assembly did with Proposition 50," argued a senior official from the Civil Rights Division.
Political Context
The legal battle represents the most significant counterpunch by Democrats in the continuing political battle that began in Texas and has spread across various parts of the country.
In contrast to elsewhere, where Republican state legislatures have implemented partisan maps, California's plan needed public consent, which it obtained with approximately two-thirds of the vote.
Wider Consequences
Democrats need to gain just a small number of GOP-controlled House seats to gain majority of the House of Representatives in next year's midterm election.
The political group controlling the majority will influence the remaining period of the current administration, deciding if a GOP-controlled legislature will continue to deliver its agenda or encounter opposition, congressional probes and possible further challenges.
